Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of SellSmart, including the mobile application and website (together, the "Service"), operated by ApexSof Solutions ("we", "us", or "our").

By creating an account or using SellSmart, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

SellSmart is intended for mobile shop owners, staff, and related business users who are at least 18 years old (or the age of majority in your jurisdiction).

If you use SellSmart on behalf of a business, you represent that you have authority to bind that business to these Terms.

SellSmart provides tools for shop inventory, purchases, sales, cash and credit books, history, reports, team access, and Safe Scan stolen-device checks. Features may change over time as we improve the product.

We do not guarantee uninterrupted or error-free operation. Maintenance, outages, or third-party issues may affect availability.

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account, including actions by staff you invite.

We may suspend or terminate accounts that violate these Terms, create security risk, or misuse the Service.

You retain ownership of the business data you enter into SellSmart. You grant us a limited license to host, process, and display that data solely to provide and improve the Service.

You are responsible for the legality and accuracy of data you upload, including IMEI numbers, buyer information, and any alerts you create.

Safe Scan helps shops check IMEIs against alerts reported by other users. Results are informational only and do not constitute legal advice, proof of ownership, or a guarantee.

You must not create false, abusive, or retaliatory alerts. Misuse of Safe Scan may result in account action.

You agree not to:

• Use SellSmart for unlawful activity
• Attempt to breach security or access other shops' data without authorization
• Abuse Safe Scan or submit knowingly false device reports
• Reverse engineer, scrape, or disrupt the Service except as allowed by law
• Misrepresent your identity or affiliation

SellSmart may offer free and paid plans. If fees apply, pricing and billing terms will be shown before you purchase. Taxes may apply where required.

SellSmart, its branding, software, and related materials are owned by ApexSof Solutions or its licensors. These Terms do not transfer ownership of our intellectual property to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

To the maximum extent permitted by law, ApexSof Solutions is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities arising from your use of SellSmart.

Our total liability for any claim relating to the Service is limited to the amounts you paid us for SellSmart in the twelve (12) months before the claim (or zero if you used only a free plan).

You agree to indemnify and hold harmless ApexSof Solutions from claims arising out of your misuse of the Service, your shop data, or your violation of these Terms.

You may request account deletion through the app or our Delete Account page. Deletion follows our retention process described in the Privacy Policy.

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles. Courts in Pakistan have exclusive jurisdiction, except where mandatory consumer protections require otherwise.

We may update these Terms from time to time. Continued use after changes become effective means you accept the updated Terms. Material changes will be indicated by an updated effective date.
